SOL – Specific Usage Rights

 

By using this Standards On-Line service to access your nominated collection of Publications, you the Customer, are agreeing to:

        (a)  the Terms & Conditions of Sale as set out at  https://infostore.saiglobal.com/en-au/subscriptions-terms-and-conditions/ and

(b)      the SOL – Specific Usage Rights as set out hereunder and 

(c) the Privacy Policy as set out at https://www.saiglobal.com/en-au/privacy/

 

(Collectively herein called the Agreement). 

 

In the event of inconsistency between a provision in the Terms & Conditions of Sale and in this SOL - Specific Usage Rights the provision in the Terms & Conditions of Sale prevails to the extent of the inconsistency.

 

This Service is supplied by SAI Global Limited ABN 67 050 611 642, Level 37, 680 George Street, Sydney NSW 2000, Australia (SAI Global)

 

1. Definitions and Interpretations

Defined terms set out herein have the same meaning as those same terms set out in the Terms & Conditions of Sale unless otherwise defined hereunder.

 

Publications means Standards and other publications for which SAI Global is an authorised distributor for:

§  AAMI - Association for Advancement of Medical Instrumentation.

§  AENOR - Asociacion Espanola de Normalizacion.

§  AHAM - Association of Home Appliance Manufacturers.

§  ANSI - American National Standards Institute.

§  ANSTAT - SAI Global.

§  API - American Petroleum Institute.

§  ARI - Air-conditioning, Heating and Refrigeration Institute.

§  ASA - Acoustical Society of America.

§  ASHRAE - American Society of Heating, Refrigeration & Air Conditioning Engineers.

§  AWWA - American Water Works Association.

§  CEI - Comitato Elettrotecnico Italiano.

§  CIA - Concrete Institute of Australia.

§  DEFFORM - UK Ministry of Defence.

§  DEFSTAN - UK Ministry of Defence.

§  ENA - Energy Networks Association.

§  ETSI - European Telecommunications Standards Institute.

§  Ford - Ford Motor Company.

§  GEIA - Government Electronics and Information Technology Association.

§  EN – as adopted and published by the National Standards Authority of Ireland.

§  ISO - International Organization for Standardization.

§  IEC - International Electrotechnical Commission.

§  JSA - Japanese Standards Association.

§  MIL - US Military.

§  NACE - National Association of Corrosion Engineers.

§  NETA - International Electrical Testing Association.

§  NFPAS - National Fluid Power Association.

§  NSAI - National Standards Authority of Ireland.

§  SAI Global - SAI Global.

§  Safety Culture - Safety Culture.

§  Standards Australia - Australian Standards, Joint ISO/Australian Standards, Joint NZ/Australian Standards, current Draft Australian Standards, and amendments to Australian Standards. Australian Standard® is the registered trademark of Standards Australia Limited. Australian Standard® branded standards and other publications are distributed by the Licensor under licence.

§  Wood Solutions - Forest and Wood Products Australia.

 

Intellectual Property means all current and future registered and unregistered rights, including copyright and trademarks, in respect of the Service.

 

Service means the provision, on the payment of an initial subscription, of online access to a Customer nominated selection of Publications in electronic format. The Service also provides access to a bibliographic database of Publications, and the Customer has the option to add Publications to the Service at any time during the Subscription Period at an additional fee per added Publication, payable at the time the Publication is added.

 

2. Customer acknowledgements, rights & obligations

The Customer acknowledges and agrees that:

(a)      it does not own the electronic downloaded files, printed files, any disks, documentation or manuals on which the Service or Intellectual Property is originally or subsequently recorded or fixed;

(b)      may use the electronic or printed files to obtain information contained in them for its internal business purposes only (and in accordance with clause 2.2 of the Terms & Conditions of Sale);

(c)      no promise, representation, warranty or undertaking (other than any contained in this Agreement) has been given by SAI Global or any person on its behalf in relation to the profitability of or any other consequences or benefits to be obtained from the use of the Service and the Customer relies wholly on its own skill and judgment in deciding to use the Service;

(d)      no warranty or representation is made by SAI Global or any party connected with this Service, express or implied, with regard to the quality, utility, completeness or accuracy of the Service; and

(e)      the licence to use the Service terminates upon termination or expiry of this Agreement.

 

The Customer may download and store electronic copies for temporary off-line uses.  The Customer acknowledges that downloaded copies are encoded with a predetermined expiry date, after which they cease to be accessible.

 

In addition to the prohibitions set out in clause 2.2 of the Terms & Conditions of Sale, the Customer must not:

(a)      challenge or call into question SAI Global’s rights and/or ownership of Intellectual Property rights in respect of the Service;

(b)      reproduce documents or portions of documents provided by this Service other than in accordance with the terms of this Agreement.  Written consent must be obtained from The Copyright Officer, Information Services, SAI Global Ltd, GPO Box 5420, Sydney NSW 2001 at copyright@saiglobal.com prior to reproducing documents or portions of documents; and

(c)      must not use the Service in a manner, or associated with material that would damage the reputation or goodwill of SAI Global or the owner of the Intellectual Property.
