A guide to title by possession (applications under s.138W of the Land Titles Act 1980) has been prepared (click here ) and can be found via the Tasmanian Online Land Dealings (TOLD) system (accessed via www.thelist.tas.gov.au) under form guide in the new Vesting Order section.

The process in relation to title by possession applications has altered in that approved forms and notices are also now available on TOLD. Solicitors for an applicant are no longer required to request notices and forms from the Land Titles Office. This makes the application process more efficient.

This is the first in a new series of guides to be prepared. Other guides currently under review are vesting order by sale (s.138D of the Act) and cancellation of easements (s.108 of the Act) which should be available soon.

If you have any feedback or comments please email titles.enquiries@dpipwe.tas.gov.au with “title by possession guide” as the subject.
