Authority Update National: ARNECC have published Version 5 of the MOR and MPR

The Australian Registrars' National Electronic Conveyancing Council's (ARNECC) have published Version 5 of the Model Operating Requirements (MOR) and Model Participation Rules (MPR) and these will come into effect on 25 February 2019.

A summary of the changes for the MOR are as follows, however we encourage you to read the new versions in full;

Changes to clauses;

    • new provisions around ELNO service fees
  • 7.2 Access to ELN
    • new provisions for application to applications technology
  • 7.11 Data Breach Notification
    • certain new requirements
  • 7.12 Cloud Service
    • requirement and provisions when using cloud services
  • 14.10 ELNO must not be a Subscriber
  • 15.4 When to demonstrate compliance
    • extra requirements for non-compliance
  • SCHEDULE 3 - REPORTING REQUIREMENTS
  • SCHEDULE 7 - SUBSCRIBER IDENTITY VERIFICATION STANDARD
    • Minimum Document Requirements

    • added a Donor, as Attorney for the Donor
  • 5.3 Subscriber who acts as Representative (deleted)

    • provisions when signing as an attorney
  • 6.4 Right to Deal
    • provision to verifying the donors right to deal when signing as an attorney
  • 6.5 Verification of identity
    • for donors
  • 6.6 Supporting evidence
    • when acting as an attorney on behalf of a donor.
  • 6.13 Mortgages
    • added mortgagee's Attorney
  • 6.15 Conduct of Conveyancing Transactions (added)
  • 7.2 Users
    • provisions for application to application technology when accessing the ELN
  • 7.4 Signers
    • added provisions for a Statutory Body Officer acting on behalf of a Statutory Body
  • 7.10 Certifications
    • for when the subscribers acts as an Attorney
  • SCHEDULE 3 - CERTIFICATION RULES
  • SCHEDULE 4 - CLIENT AUTHORISATION
    • new version will come into effect at the same time as Version 5 being 25th February 2018
    • ARNECC will publish the revised Smartform and flatform in due course, you can check for new version https://www.arnecc.gov.au/publications/forms
    • new, deleted and amended terms of a Client Authorisation
    • new Client Authorisation form when acting as an attorney
  • SCHEDULE 6 - INSURANCE RULES
    • added a Local Government Organisation or a Statutory Body as a self-insuring Subscribers and Identity Agent
    • Changes to deemed compliance Insurance Rules
  • SCHEDULE 7 - SUSPENSION EVENTS, TERMINATION EVENTS AND SUSPENSION AND TERMINATION PROCEDURE
    • added a suspensions event.
  • SCHEDULE 8 - VERIFICATION OF IDENTITY STANDARD
    • added, deleted definition's
    • changes to minimum document requirements
